texTure MMS - Privacy Policy and Terms of Use

This policy was created by Oyster Mobile Software, LLC. It applies to the use of texTure MMS (the Software) for the transmission and upload of picture messages, and distribution of weblinks so that recipients may view the messages. As a user of the Software, Oyster Mobile Software, LLC respects your privacy and makes every effort to maintain it.

Uploading Picture Messages

In using the Software, your picture messages will be uploaded to our servers; they will be stored temporarily if you send a message to a recipient using the "Weblink" option (messages sent using only the "MMS" option are immediately discarded). No personal information - i.e. name, email address - is uploaded to our server or stored for any length of time; only the image, message content and time are stored. This information is stored briefly, for an amount of time that Oyster Mobile Software, LLC deems sufficient for recipients to view the messages. After this, the message and image data are discarded.

In storing your messages and images, Oyster Mobile Software, LLC has taken every precaution to ensure that they remain viewable only to those you send them to. However, as data must be transmitted from your phone to our servers, stored on our servers for a period of time (however brief), and transmitted from our servers to your recipients, complete security of this data cannot be ensured. Therefore, in using the Software, you accept the risk of a third party possibly gaining access to this data and assume all responsibility for consequences or damages that may result from said third party access.

Message Content

Oyster Mobile Software, LLC places no restrictions on who may purchase its software, who may use it, and how they use it. Therefore, Oyster Mobile Software, LLC is free of all responsibility for the content of images or messages transmitted or stored temporarily on its servers by use of the Software. Oyster Mobile Software, LLC shall not be held responsible or liable for the upload or transmission of any content that may be considered lewd, offensive, inappropriate, dangerous, illegal, or in conflict with the public interest that results from use of the Software. The user agrees to accept full liability and responsibility of all content, including that described above, that is uploaded or transmitted as a direct or indirect result of their usage of the Software.

Terms Of Use

You, the user, agree to indemnify and release from liability Oyster Mobile Software, LLC, its members, and its agents regarding any losses experienced, damages incurred, or events transpiring as a direct or indirect result of your use of the Software. You agree to assume all legal and fiscal responsibility for any content transmitted due to your use of the Software, and any consequences arising out of the transmission of said content.
